These Terms of Service (“Terms”) govern your access to and use of the Hekaya Books website, online store, and related services (collectively, the “Services”).

SECTION 3 – ORDERS AND PURCHASES

When you submit an order through the Services, you are making an offer to purchase the selected products under the terms displayed at checkout.

Your order information, including the products, prices, applicable taxes, shipping charges, and other applicable terms, will be presented during the checkout process.

An order confirmation acknowledges receipt of your order. Where applicable, the contract is concluded in accordance with applicable law and the terms presented to you during the purchase process.

Hekaya Books may contact you if information necessary to process your order is missing or unclear.

If an order cannot be fulfilled for a reason permitted by applicable law, we will notify you and provide any refund or other remedy required by law.

Nothing in these Terms permits Hekaya Books to cancel or refuse a completed transaction for a reason prohibited by applicable consumer protection legislation.

SECTION 4 – PRICES, TAXES, AND BILLING

Prices displayed on the website are subject to change before a purchase is completed.

The price applicable to your purchase is the price presented to you at the time your order is placed, together with any applicable taxes, shipping charges, or other disclosed fees.

You agree to provide accurate and complete billing and payment information.

You represent that you are authorized to use the payment method provided for your purchase.

If a payment cannot be processed, we may request an alternative valid payment method before fulfilling the order.

SECTION 11 – SHOPIFY

Hekaya Books uses Shopify to provide the technology supporting our online store.

Your purchase is made directly with Hekaya Books. Shopify does not sell our products to you and is not responsible for the products, fulfillment, returns, refunds, or customer-service obligations associated with your purchase from Hekaya Books.

SECTION 12 – PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

By using the Services, you acknowledge that you have reviewed our Privacy Policy.

SECTION 13 – CUSTOMER FEEDBACK

Hekaya Books does not guarantee that the Services will always be uninterrupted, secure, error-free, or available at all times.

SECTION 18 – LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Hekaya Books will not be liable for indirect, incidental, special, or consequential losses arising from your use of the Services.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for rights or remedies that cannot legally be excluded or limited.

For consumer transactions, this section is subject to all mandatory protections provided by applicable consumer protection legislation.

SECTION 19 – INDEMNIFICATION

To the extent permitted by applicable law, you agree to be responsible for losses or claims directly resulting from your unlawful use of the Services, your violation of these Terms, or your infringement of another person's rights.

Nothing in this section requires you to indemnify Hekaya Books for matters for which such indemnification cannot legally be required.

SECTION 21 – NO WAIVER; ENTIRE AGREEMENT

Our failure to enforce a provision of these Terms does not constitute a waiver of that provision.

These Terms, together with the policies and terms expressly referenced herein, constitute the agreement governing your use of the Services and purchases from Hekaya Books, subject to any mandatory rights provided by applicable law.

If there is a conflict between these Terms and a mandatory consumer protection law, the applicable law will prevail.

SECTION 22 – ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent, except where such restriction is prohibited by applicable law.

Hekaya Books may assign or transfer its rights and obligations where permitted by law and where this does not adversely affect your mandatory consumer rights.

SECTION 23 – GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws applicable in Québec, Canada, except to the extent that mandatory consumer protection laws of another jurisdiction apply to your purchase.

For consumers residing in Québec, nothing in these Terms prevents you from exercising rights before a Québec court or from relying on protections provided by Québec consumer protection legislation.

Where mandatory laws in your place of residence provide additional consumer rights or remedies, those rights remain unaffected.

We may update these Terms from time to time to reflect changes to our Services, business practices, or legal requirements.

Changes will apply from the effective date stated in the updated Terms and will not retroactively alter rights or obligations arising from purchases already completed, except where required or permitted by law.
